DESPITE boasting one of the largest potential markets in the US with a population of almost 30 million, sports betting still appears a long way from being legalized in the Lone Star State. While there was some movement during the 2023 legislative session, with an expanded gambling bill passing through the House, it failed to gain traction in the Senate.

Unfortunately, that is unlikely to change for the new session, as Lieutenant Governor Dan Patrick has made it clear that he will not support any gambling legislation unless backed by a Republican majority. Historically, gambling bills have been championed by Democrats.

Any expansion of gaming in Texas would require voter approval through a constitutional amendment, with November 2025 being the earliest potential date for such a referendum.

In November 2024, Democratic Senator Carol Alvarado filed SJR 16, a constitutional amendment proposal that seeks to significantly expand gaming in Texas. This proposal includes provisions for seven destination casino-resorts, which would be located in major metropolitan areas like Dallas-Fort Worth, Houston, San Antonio, Corpus Christi, and McAllen. The plan sets a 15% tax rate on casino gross gaming revenue and prioritizes some existing pari-mutuel facilities to accelerate job creation and economic development.

As for sports betting, the proposal defines it as “placing a wager on the outcome of a live sporting event,” but no clarity on whether the focus would be on in-person or digital wagering.

Texas Online Betting

No online or land-based sports betting is currently available in Texas, and with the legislative hurdles in place, significant changes are unlikely in the near term. Texans looking for sports betting options often cross state lines into Louisiana, where both in-person and online betting are legal.

TX Casinos

Online casinos are illegal in Texas, with just two land-based venues offering limited gambling options. The Kickapoo Lucky Eagle Casino in Eagle Pass, near the Mexican border, provides the only traditional casino experience, including poker rooms, slots, and electronic gaming. The Naskila Gaming facility in Livingston also offers slots and electronic gaming, but online casino gaming remains off the table.

Texas Poker and Card Rooms

There is no online poker legally available in Texas. The Kickapoo Lucky Eagle Casino remains the only land-based venue offering legal poker rooms. However, independent poker clubs operate in a legally gray area, providing an alternative for enthusiasts willing to navigate uncertain territory.

Texas Horse Racing Betting

Horse racing fans can enjoy live events at four tracks across the state, with on-site betting facilities and simulcast wagering for races around the US. However, all betting must be conducted on-site, as online horse racing betting is not permitted.

Lottery in Texas

The Texas Lottery has been operational for over 30 years, offering a range of games to players aged 18 and over. Tickets can only be purchased from licensed retailers, as online ticket sales are not allowed.

Texas DFS

Daily Fantasy Sports (DFS) platforms like FanDuel and DraftKings are available to Texas residents, though their legality is still a gray area. There have been no significant moves to formally regulate DFS in the state.
